In Texas, individuals who have suffered injuries due to the negligence or wrongful actions of others may pursue various types of financial compensation in a personal injury claim.
It’s important to note that the specific types and amounts of compensation available in a personal injury claim can vary depending on the circumstances of the case, the severity of the injuries, and other unique factors.
Some common types of financial compensation that can be pursued in a Texas personal injury claim include:
This includes compensation for past, current, and future medical expenses related to the injury. It may cover hospital bills, surgery costs, medication expenses, rehabilitation costs, and other medical treatments necessary for recovery.
If your injuries prevented you from working, you may be entitled to compensation for lost wages and income. This can include both past lost wages and future earning capacity if the injury affects your ability to work in the long term.
Compensation may be awarded for the physical pain and emotional distress caused by the injury. This can include compensation for physical discomfort, mental anguish, emotional distress, and loss of enjoyment of life.
If the injury results in scarring, disfigurement, or permanent disability, you may be entitled to compensation for the physical and emotional impact of these permanent changes to your appearance or abilities.
In cases where the injury affects your relationship with your spouse, you may be entitled to compensation for the loss of companionship, affection, and support suffered by your spouse due to the injury.
In cases where the at-fault party’s actions were particularly egregious or reckless, the court may award punitive damages as a punishment and deterrent. However, Texas law limits punitive damages, which are not granted in all cases.
At the Carlile Law Firm, LLP, our personal injury lawyers in Marshall believe in delivering actual results for our clients, including financial wins, justice, and change.
We understand that financial compensation is an essential part of our cases, as it helps injury victims and their families mitigate the financial burden placed on them due to no fault of their own.
We seek justice by holding the at-fault party accountable for their actions and ensuring that the injured party receives fair treatment under the law. Justice acknowledges the harm suffered and aims to restore dignity and respect to our clients. It also sends a message that negligent behavior will not be tolerated and that individuals are responsible for the consequences of their actions.
Finally, we seek change by highlighting safety deficiencies or systemic issues to lead to reforms in laws, regulations, or industry standards to protect public safety and prevent future injuries and fatalities.
Together, these elements play crucial roles in personal injury claims, serving the interests of injured individuals and their families and contributing to a safer and more just society.
That has never been more true than in 2018, when the Carlile Law Firm, LLP represented the family in the wrongful death civil case of Kari Hunt Dunn, who was fatally stabbed at the Baymont Inn in Marshall by her husband in December 2013. The couple’s then-9-year-old daughter made four attempts to dial 911 to no avail because she didn’t realize she had to dial an extra “9” to reach an outside line.
Our law firm represented the couple’s children and Kari’s father in a wrongful death lawsuit against hotel owner OM Lodging LLC and Kari’s husband, Brad Dunn. At trial, our attorneys proved that in addition to Brad Dunn being liable the hotel was also responsible for Kari’s death because the hotel was negilgent in hiring, supervising, and trianing the hotel staff. The 12-person Marshall jury awarded her family $41.55 million in damages.
More importantly, because of Hunt’s efforts, states enacted Kari’s Law, named after his daughter, which President Donald Trump later signed into law. The real change is that the law now requires all businesses to enable direct-dial access to 911, so no one will have to experience Kari’s daughter’s struggle as she tried to call for help.
